Notice to Appear

The Notice to Appear or "NTA" is an important document that begins the Removal Proceedings. It also has important legal significance for both you and DHS. For you, the information tells you the reason DHS wants you removed from the country. For DHS, the NTA is significant because it must be filled out completely, with no missing information. If information is missing, DHS may not be able to proceed with your removal. While it's unlikely they will give up, it may give you more time.

Date and TimeWhen looking at a Notice to Appear (NTA), it is critical that you look to see if the date and time of the Court Hearing is listed on the NTA. If the date and time is missing, you may be able to ask the Court to dismiss the case.

What if the Notice is not Signed?

Frequently, the back page is not signed by you. At the moment, the lack of a signature does not have particular significance for the proceedings. However, if you have never been given the Notice to Appear, you should raise this issue with the Immigration Court.
